A Texas couple sued Apple after their son suffered “permanent hearing loss” while using its AirPods.
Carlos Gordua and Ariani Reyes of San Antonio are demanding more than $75,000 in damages from Apple, after their 12-year-old son suffered hearing loss when an “Amber Alert” went off while using the headphones, according to USA Today. American.
The accident occurred in May 2020, when the boy was watching “Netflix” through “AirPods”, which had been purchased for him 6 months ago.
The boy was watching the smart platform on his iPhone, connected to the “AirPods” headphones with a low sound, but from them the “Amber Alert” suddenly went off, causing tearing of his eardrum and damaging its shell, according to the lawsuit filed against “Apple”.
The lawsuit also alleges that the boy “has also suffered from episodes of dizziness and nausea” since the accident, as well as psychological distress and emotional trauma, and will have to use a stethoscope for the rest of his life, in order to improve his hearing.
It also claims that the AirPods have design flaws, or lack adequate warnings of the risks of use.
The child’s parents claim that the AirPods do not “automatically reduce, control, limit or increase the volume of notifications or alerts to a safe level”, and that Apple does not provide instructions to limit the volume of alerts to prevent hearing damage.
The couple argue that Apple didn’t solve the problem, and if they weren’t aware of the problem, they should have known.
The “Amber Alert” is a smartphone system in cooperation with local authorities to inform about the presence of kidnapped children nearby.
