A South Korean court has ruled against a same-sex couple demanding the same marital health insurance coverage as heterosexual couples.
According to Yonhap Agency, the Seoul Administrative Court affirmed in the ruling that “the union between a man and a woman is still understood as the basic element of marriage on the basis of the existing civil law and case law of the Supreme Court and the Constitutional Court,” noting that there is no legal basis for expanding the concept of marriage. to include same-sex marriage.
The court affirmed that the National Health Insurance Service did not violate the principle of equality under the constitution, adding that union between a man and a woman and a union between homosexuals “cannot be considered fundamentally equal”.
The court noted that marriage in South Korea is still considered a union between a man and a woman.
In February last year, Soo Sung-ok filed an administrative lawsuit against the National Health Insurance Service (NHIS) after the agency canceled Soo’s coverage under his male partner’s employer insurance program.
